James Comey Indicted: Former FBI Director Faces Two Federal Charges

Former FBI director James Comey indicted on two charges.

A federal grand jury in Virginia has indicted former FBI Director James Comey on two felony charges tied to his testimony before Congress in 2020. The indictment, unsealed Thursday, accuses Comey of making false statements to lawmakers and obstructing a congressional proceeding—both carrying potential prison sentences of up to five years.

The charges stem from Comey’s sworn testimony before the Senate Judiciary Committee, where he denied authorizing FBI officials to serve as anonymous sources in media reports about sensitive investigations. Prosecutors allege that Comey knowingly misled senators, contradicting evidence that he had, in fact, directed an FBI contact to speak with reporters.

Comey, who was fired in 2017 by President Donald Trump, responded defiantly in a video statement, declaring his innocence: “I am innocent. So, let’s have a trial.” He added that he had “great confidence in the federal judicial system” despite what he described as political pressure surrounding the case.

The indictment makes Comey the first former FBI director to face criminal charges for testimony to Congress. Legal experts note that prosecutors will need to prove not only that Comey’s statements were false, but that he knowingly and intentionally misled lawmakers—a high bar in court.

Comey is scheduled to be arraigned on October 9 in federal court in Alexandria, Virginia.
